Terms of Service

1.Acceptance of these Terms

Talking Photos (talkingphotos.app and the Talking Photos Android app, the “Service”) is operated by My Little Indie Studio (“we”, “us”). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 16 years old to use the Service. The optional “Uncensored 18+” mode of the dialogue assistant is only for users who are at least 18 years old (see AI-generated output).

2.Penggunaan aplikasi Android

Ketentuan ini juga berlaku untuk Android. Pembelian menggunakan Google Play Billing dan ketentuan pembelian Google. Harga ditampilkan sebelum pembayaran. Kelola atau batalkan langganan Play di Google Play; pembatalan menghentikan perpanjangan berikutnya dan PRO berlaku sampai akhir periode berbayar. Pengembalian dana mengikuti prosedur Google Play dan hukum konsumen yang berlaku.

3.What the Service does

The Service lets you add a cartoon or animated face to photos, write or generate a short dialogue, give the characters synthesized voices and export the result as an MP4 video. Some features use third-party AI providers (see the Privacy Policy). Features, limits and prices may change as the Service evolves.

4.Your account

• Provide a valid email address you control and keep your password secret.
• You are responsible for everything done through your account. Tell us at info@talkingphotos.app if you suspect unauthorized access.
• One person per account; do not share, sell or transfer accounts.
• You can delete your account at any time in your profile (“Delete account”). This permanently deletes your scenes, heroes, files and token balance. Deleting the account does not cancel a paid subscription; cancel it first in the subscription portal (see Prices, renewals and cancellation).

5.Acceptable use

You may only upload photos, clips and images that you own or have permission to use. In particular, you must not use the Service to:

• animate a real, identifiable person without that person’s consent (or a guardian’s consent for a minor);
• impersonate anyone or create deceptive content (“deepfakes”) that could reasonably be mistaken for real statements or actions of a real person;
• harass, bully, threaten, defame or humiliate anyone, or promote hatred or violence against people or groups;
• create sexual, sexualized or pornographic content of any kind, or any content that exploits or endangers children;
• create or share illegal content, or content that infringes copyright, trademark, privacy, publicity or other rights;
• mislead people for fraud, scams, political manipulation or spam, or remove the context needed to see that a video is AI-generated (see AI labels and Content Credentials);
• probe, overload, reverse engineer or bypass the Service’s limits, security or payment checks, or access it by automated means other than the app itself.

We may remove content, limit features or suspend accounts that break these rules, and we report illegal content to the authorities where the law requires it.

6.Photos of real people

Talking Photos animates faces, so before your first photo or clip upload we ask you to tick one box and confirm three things. The confirmation covers every photo, clip and image you add afterwards:

• the photo is yours, or you have permission to use it;
• every recognizable person in it has agreed to be animated and given a voice — for a child, their parent or legal guardian has agreed;
• you will not use the result to deceive, impersonate or harass anyone.

For an account we record the date and time of this confirmation with the account (see the Privacy Policy); without it the Service does not accept photo or clip uploads. Without an account the confirmation is kept only in your browser, together with the photos, which stay on your device. If you later sign in, we ask once more for the account.

If a person withdraws their consent, delete the scenes, heroes and videos that show them. If you find a video made from your photo, or of you or your child, without consent, write to info@talkingphotos.app and we will act on it promptly.

7.AI labels and Content Credentials

Every video exported from the Service, on every plan, is marked as AI-generated in two ways (details on our AI transparency page):

• a visible “AI” label in the top-right corner of the picture, shown for the whole video;
• machine-readable marks: digitally signed C2PA Content Credentials and descriptive metadata in the MP4 file, and an imperceptible watermark in the soundtrack.

You must not remove, crop out, cover, blur, shrink, alter or otherwise hide the visible label, and you must not strip, edit, forge or tamper with the Content Credentials, the metadata or the audio watermark (for example by editing the file or re-encoding it in order to defeat them), or help anyone else do so. Editing a video is fine as long as the label stays visible in the corner whenever generated footage is on screen.

If you publish videos made with the Service as part of a business or professional activity — for example marketing, advertising, a media outlet or content you produce for clients — you are a “deployer” under Article 50(4) of the EU AI Act and must disclose that the content was artificially generated or manipulated. Keep the visible label in the published video; it is designed to meet that duty. For evidently artistic, creative, satirical or fictional works the disclosure may be placed so that it does not spoil the work, but it must still be clear and present at the latest when people first see the video. Platform-level AI labels, captions and descriptions are welcome additions; they do not replace the label in the video.

8.Your content and our license

You keep all rights to the photos, clips, images, names, personas and dialogue you add (“your content”) and to the videos you export, to the extent you hold the underlying rights.

You grant us a worldwide, non-exclusive, royalty-free license to store, copy, process and transform your content, and to send it to the processors listed in the Privacy Policy, only as needed to operate the Service for you (for example to synthesize speech, generate a dialogue or render a video). The license ends when you delete the content or your account, except for copies in backups, which expire on their own schedule. We do not publish your content and do not use it to train AI models.

You are responsible for your content and for how you use the videos you export. You confirm that you have all rights and consents needed for it.

9.Storage and retention

We keep your uploaded and generated content while you use your account, subject to the storage limits and retention rules described here and in the Privacy Policy. Temporary processing files, failed jobs, unreferenced intermediate files and uploads not finished within 24 hours may be deleted earlier when they are no longer needed.

Storage. A free account can store up to 500 MB of files (photos, clips, voice recordings and exported videos). When the storage is full, new uploads, voicing and video exports are blocked until you delete projects or files or upgrade to PRO. Files you already have are kept. PRO accounts have no storage limit.

If you do not sign in or use the Service with your account for 12 months, we email you at least 30 days in advance and, if you still do not sign in by the stated date, delete your scenes, videos, saved heroes and uploaded photos. Your account, token balance and purchase history are kept. Accounts with an active PRO plan are not affected. Please keep your own copies of videos you want to keep.

To keep the Service sustainable, manage security and control storage costs, we may introduce or change storage limits or retention periods for content and backups. If a change materially shortens the time we keep your content, we will notify registered users at least 30 days before it takes effect by email or in the app, identify what is affected and the effective date, and give you a reasonable opportunity to download content you want to keep. After that date, affected content may be permanently deleted. This notice period may be shorter where required for security, abuse prevention, legal compliance or an urgent provider or infrastructure failure, where permitted by law.

10.AI-generated output

Voices, dialogue suggestions, face points and animations are produced automatically. They can be inaccurate, unexpected, repetitive or, in rare cases, offensive, and similar output may be produced for other users. Review every result before you publish or share it; you are responsible for what you publish.

The dialogue assistant has an optional “Uncensored 18+” mode. Turn it on only if you are at least 18 years old; by turning it on you confirm that you are. In this mode suggestions may contain profanity, dark humor and harsh insults between the characters. Sexual content stays prohibited in every mode, and the mode does not change the acceptable-use rules above for anything you create or share.

Voices are synthetic and are not intended to imitate any real person. Do not present generated videos as real recordings of real people. Every exported video carries the AI label and marks described in AI labels and Content Credentials.

11.PRO subscription and tokens

Web payments are processed by Dodo Payments, our reseller and Merchant of Record. Dodo Payments sells you the subscription or token pack, charges your payment method, handles taxes and issues invoices; their checkout terms apply to the purchase. Android purchases are processed by Google Play Billing under Google’s purchase terms, as described above. We never see your card details.

• PRO is a monthly or yearly subscription that renews automatically until you cancel. It unlocks PRO features and includes a monthly allowance of 600 tokens (on the yearly plan too, refreshed every month).
• Monthly allowance tokens are spent first and do not roll over: whatever is left burns at the end of each monthly period and when PRO ends.
• Purchased tokens from token packs never expire while your account exists. Free and PRO accounts can buy packs.
• Tokens are paid for Gemini voices, the dialogue assistant and auto-montage (“Arrange with AI”); costs are shown in the app before you spend. Tokens have no cash value, cannot be exchanged for money and cannot be transferred to another account. They are lost when you delete your account.
• Free accounts start with 0 tokens. There is no free trial of PRO.

12.Prices, renewals and cancellation

Current web prices are shown on the PRO page and at checkout; Android prices appear in Google Play before payment. We may change prices; a new price for an existing subscription applies only from a renewal after we have notified you by email, and you can cancel before it takes effect.

You can cancel the subscription at any time in the Dodo Payments customer portal (“Manage subscription” on the PRO page) for web purchases, or in Google Play for Play purchases. After cancellation PRO stays active until the end of the period you have already paid for and is not renewed; then the account becomes free. Your purchased tokens stay.

13.Suspension and termination

We may suspend or close an account that breaks these Terms, endangers other people or the Service, or is involved in fraud or chargebacks. Where reasonable we will tell you why and give you a chance to respond. If we close an account without such a reason, or shut the Service down, we will refund the unused part of a prepaid subscription and unused purchased tokens. You may stop using the Service and delete your account at any time.

14.Availability and changes to the Service

We work to keep the Service running, but it is provided “as is” and “as available”. It may be interrupted for maintenance, provider outages or reasons outside our control, and providers may limit some features (for example when a daily voice budget is reached). Keep your own copies of videos you want to keep.

15.Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for loss of profits, data or goodwill, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid for the Service in the 12 months before the claim.

Nothing in these Terms limits liability that cannot be limited by law, such as liability for intent or gross negligence, or your statutory rights as a consumer.

16.Governing law

These Terms are governed by the laws of Estonia, without regard to conflict-of-law rules. If you are a consumer in the EU, you also keep the protection of the mandatory laws of your country of residence and may bring a claim there.

17.Changes to these Terms

We may update these Terms as the Service changes. The date at the top shows the latest version. For material changes we will notify registered users by email or in the app before they take effect. Changes that materially shorten storage or backup retention are subject to at least 30 days’ notice as described above. Continuing to use the Service after a change takes effect means you accept the updated Terms; if you do not, delete your account.
